On 13-14 April 2017 EURALIUS in collaboration with the School of Magistrates organized the training “On trial in absentia in the light of Article 6 of the European Convention of Human Rights and European Court of Human Rights Case Law particularly focusing on the presence of the defendant in the trial”.

In this training participated more than 40 Albanian judges and prosecutors.

Albanian and international experts presented different aspects of trial in absentia based on domestic legal framework and EU approach, illustrated with case law of European Court of Human Rights.

Mr. Sander Simoni made an introduction of the trial in absentia according to Albanian Legislation, its novelties according to the new amendments of Criminal Procedure Code and issues of its application in the judicial practice.

Mr. Idlir Peçi, gave a comprehensive overview of the jurisprudence of the European Court of Human Rights on Trial in Absentia by presenting several important cases. 

German Experts, Mr. Stefan Trunk, Senior Prosecutor at the Prosecution Office of Duisburg and Mr. Michael Bolz, Senior Prosecutor at the Prosecution Office of Frankfurt presented respectively the meaning of sentence in absentia for the principle of mutual recognition within the EU legal framework, including the minimal standard and the German legal framework concerning trial in absentia.

The training was illustrated by two practical case studies on the topic and was characterized by high professional and interactive level of the discussions by the participants.
