EURALIUS in cooperation with the High Justice Inspector (HJI), elaborated and published a Manual on Disciplinary Investigations against Judges and Prosecutors. It is a joint product of EURALIUS and of the HJI, a long attended and advantageous tool.
The Manual is a comprehensive instrument designed to facilitate the challenging work of the HJI during disciplinary investigation of alleged misconducts of judges, prosecutors and members of the Councils.
Moreover, the Manual may serve as beacon to better understand the new system of disciplinary liability adopted as part of the Justice Reform.
The Manual provides for an extensive commentary aiming at ensuring a uniform interpretation of all dispositions related to the disciplinary investigation of alleged misconducts of magistrates and members of the Council, respectively of Articles 118 to 137 of Law no. 96/2016 "On the Status of Judges and Prosecutors in the Republic of Albania", as amended.
Additionally, the Manual contains seventy (70) standard forms that are to be used by inspectors of the HJI throughout the procedural stages of disciplinary investigations of judges and prosecutors.
